TERMS OF SALE

Toile Designs LLC dba DIY Fashion Design Last Updated: February 16, 2026

By placing an order for physical goods (fabrics) or digital products (sewing patterns) on www.diyfashiondesign.com or www.toiledesigns.com, you agree to the following terms:

1. THE CONTRACT

●     Direct Purchase: You are purchasing directly from Toile Designs LLC.

●     Order Acceptance: Your order constitutes an offer to buy. Our acceptance of that offer occurs only when we send an Order Confirmation email. We reserve the right to cancel any order for reasons including, but not limited to: product availability, errors in pricing/description, or suspected unauthorized or illegal transactions.

2. DIGITAL GOODS (SEWING PATTERNS)

●     Delivery: Digital patterns are delivered via an automated download link sent to the email address provided at checkout.

●     Troubleshooting: If a download link fails to arrive or function, please contact info@diyfashiondesign.com. We will verify your purchase and re-issue the link within 48 business hours.

●     No Refunds on Digitals: Due to the nature of digital content, all sales of digital sewing patterns are final. Once a download link has been issued, the order cannot be canceled or refunded.

3. PHYSICAL GOODS (FABRIC)

●     Cutting Policy: Fabric is sold by the yard and is cut specifically for your order. Because cut-to-length fabric cannot be resold, all fabric sales are final.

●     Returns: We only accept returns for physical goods if the item is defective or if the incorrect item was shipped. Claims must be made within 7 days of delivery.

●     Color Variation: We strive for color accuracy, but because monitor displays vary, we cannot guarantee an exact color match between your screen and the physical fabric.

4. SHIPPING & RISK OF LOSS

●     Territory: We currently ship physical goods to the United States only.

●     Responsibility: All physical items are purchased pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier (USPS, UPS, etc.).

●     Claims: We are not responsible for packages lost or stolen after they have been marked "Delivered" by the carrier.

5. INTELLECTUAL PROPERTY & USAGE LIMITS

●     Personal Use Only: All sewing patterns purchased from Toile Designs LLC are for personal, non-commercial use only.

●     Commercial Restriction: You may not use our patterns to produce garments for commercial sale. You may not resell, redistribute, or share the digital pattern files in any form.

6. LIMITATION OF LIABILITY

Toile Designs LLC shall not be liable for any fabric shrinkage, damage caused by improper washing/care, or errors in garment construction. Our maximum liability is limited to the purchase price of the item in question.

7. GOVERNING LAW

Any disputes arising from a purchase on this Site shall be governed by the laws of the State of Colorado and resolved in the courts of Pitkin County, Colorado.
